إن المفاوضات كانت ولا زالت الوسيلة الأولى المفضلة للتفاهم لحل النزاعات، وتطورت بتطور وإزدهار النشاط الإقتصادي وخاصة ما يتعلق بإبرام عقود الدولة الإقتصادية، فالتفاوض اليوم أصبح علما قائما بذاته، لأنه يعتمد على أسس وخصائص، فهذه المرحلة ما قبل التعاقدية تنشأ عنها مشكلات قانونية أهمها الإلتزامات التي تقع على عاتق الأطراف المتفاوضة، وينتج عنها في حالة الإخلال بها طلب التعويض، كما أنها إذا تكللت بنجاح مهدت لإبرام الصفقة أو العقد بصفة نهائية، بعد إمكانية إنشاء عقود تمهيدية تتضمن شروط وأسس يتفق عليها الطرفين لكي لا يتم الرجوع إليها خلال إبرام العقد النهائي.

Has become an autonomous science because it depends on fundamentals and characteristics. The obligations of the negotiating parties and, if successful, prepare the final conclusion of the transaction or contract after the possibility of establishing preliminary contracts containing terms and bases agreed between the parties so as not to be mentioned in the conclusion of the final contract |
