ا ﻟﻣﺎ ﺷﻬدﺗﻪ اﻟﺑﯾﺋﺔ ﻣن اﻧﺗﻬﺎﻛﺎت وﺗدﻫور اﻟوﺿﻊ اﻟﺑﯾﺋﻲ، ﻣﻣﺎا ﻧظروأوﻟﻰ ﻟﻪ اﻫﺗﻣﺎﻣﺎ ﻛﺑﯾر اف ﺑﻪ ﻋﻠﻰ اﻟﻣﺳﺗوى اﻟداﺧﻠﻲ ﻣواﻛﺑﺔة ﻫذا اﻟﺣق و اﻻﻋﺗردﻓﻊ اﻟﻌدﯾد ﻣن اﻟدول إﻟﻰ دﺳﺗر ﻟﻠﺗطور اﻟﺻﻧﺎﻋﻲ و اﻟﺗﻛﻧوﻟوﺟﻲ، ﻣن ﺧﻼل اﻟﻣﺻﺎدﻗﺔ ﻋﻠﻰ اﻟﻌدﯾد ﻣن اﻟﺻﻛوك اﻟدوﻟﯾﺔ ﻫﺎ ﻣن اﻟدول ﺣﺛت ﻋﻠﻰ ﺗﻛرﯾس اﻟﺣق ﻓﻲ اﻟﺑﯾﺋﺔاﺋر ﻛﻐﯾراﻟﺗﻲ ﺗﻌﻧﻰ ﺑﺣﻣﺎﯾﺔ اﻟﺑﯾﺋﺔ، واﻟﺟز ﻫﺎ اﻟﻣﺗﻌﺎﻗﺑﺔ و اﻷﺑرز ﺗﻌدﯾل دﺳﺗورﺿﻣن دﺳﺎﺗﯾر2020اﺣﺔ ﻋﻠﻰ ﻫذااﻟذي ﻧص ﺻر اﻟﺣق. وﺳﻧﺣﺎول ﻓﻲ ﻫذﻩ اﻟورﻗﺔ اﻟﺑﺣﺛﯾﺔ ﺗﺣﻠﯾل واﺳﺗﻘي ﻣناﺋراء ﻣوﻗف اﻟﻣؤﺳس اﻟﺟزر ﺗﻛرﯾس اﻟﺣق ﻓﻲ اﻟﺑﯾﺋﺔ ﺿﻣن اﻟدﺳﺎﺗﯾر وﺧﺎﺻﺔ ﺗﻌدﯾل دﺳﺗور2020، وﻣﺎ ﻣدى ﻛﻔﺎﯾﺔ ة؟اﻟﻧﺻوص اﻟﻘﺎﻧوﻧﯾﺔ وﻣﻼﺋﻣﺗﻬﺎ ﻵﻟﯾﺔ اﻟدﺳﺗر Abstract International environmental law has played an important role in promoting the citizen’s right to a healthy environment, and paid great attention to it due to the violations witnessed by the environment and the deterioration of the environmental situation, which prompted many countries to constitutionalize this right and recognize it at the internal level to keep pace with industrial and technological development. By ratifying many international instruments concerned with the protection of the environment, Algeria, like other countries, urged the enshrinement of the right to the environment within its successive constitutions, most notably the amendment of the Constitution of 2020, which explicitly provided for this right. In this research paper, we will try to analyze and extrapolate the position of the Algerian founder regarding the enshrinement of the right to the environment within constitutions, especially the amendment of the 2020 constitution, and the extent to which the legal texts are adequate and appropriate to the constitutional mechanism?
