تم تأسيس مجلس الدولة كهيئة مقومة لنشاط الهيئات القضائية الإدارية بموجب المادة 152 من الدستور، التي كرست نظام الازدواجية القضائية في الجزائر، حيث أسندت المادة 119 من دستور1996 المعدل والمتمم وكذا المادة 4 من القانون العضوي 98-01 إلى مجلس الدولة مهمة تتمثل في اختصاصه الاستشاري، حيث يبدي رأيه للحكومة حول جميع مشاريع القوانين قبل عرضها على مجلس الوزراء، وقد وسع التعديل الدستوري 2016 في المادة 142 في هذا الدور ليشمل المشاريع الأوامر التي يصدرها رئيس الجمهورية ، وكذا المادة 4 من القانون العضوي 18-02 المعدل والمتمم للقانون العضوي 98-01 و كذلك تعددت المهام القضائية لمجلس الدولة واهتمامه بالاختصاص الابتدائي والنهـائي وبـالطعون بالاستئناف و الطعن بالنقض.
Summary: The State Council was established as a regulating body for the activity of administrative judicial bodies under Article 152 of the Constitution, which established the system of judicial duplication in Algeria.
