ملخص
تعتبر الصفقات العمومية وسيلة الدولة في التنمية وإخضاعها للرقابة من ابرز الوظائف الإدارية التي تهدف لضمان حسن تسير المال العام، فقد أولها المشرع اهتماما خاصا في نصوصه خاصة فيما يخص الصفقات العمومية نظرا لخطورتها ومالها من صلة بالخزينة العمومية وما توظفه من أموال ضخمة في مجالها، وذلك من خلال ما جاءت به قوانين الصفقات العمومية المختلفة والتي كان اخرها قانون رقم 23-12 المؤرخ في 5 أغسطس 2023 المتضمن القواعد العامة المتعلقة بالصفقات العمومي، والذي خصص المواد من المادة 94 إلى المادة 103 لتنظيم الرقابة على الصفقات وقسمها الى رقابة داخلية ورقابة خارجية ورقابة وصائية، وذلك لضمان احترام القانون وتكريس مبدأ الشفافية والمساواة بين المتعاملين والحد من انتشار الفساد في مجال الصفقات العمومية. Summary. Public procurement is considered the state’s means of development, and subjecting it to oversight is one of the most prominent administrative functions that aims to ensure the proper management of public funds. The legislator has given it special attention in its texts, especially with regard to public procurement, given its seriousness, its connection to the public treasury, and the huge amounts of money it employs in its field This is through what was stated in the various public procurement laws, the most recent of which was Law No.23-12 of August 5, 2023 containing the general rules related to public procurement, which allocated articles from Article 94 to Article 103 to regulate the oversight of transactions and divided them into internal oversight, external oversight, and oversight Guardian, in order to ensure respect for the law, establish the principle of transparency and equality among customers, and limit the spread of corruption in the field of public procurement.. |
