ملخص
تتناول هذه المذكرة بالدراسة والتحليل دور القاضي الإداري في تسوية المنازعات الناشئة عن الصفقات العمومية، باعتبارها أداة قانونية وإدارية أساسية لتحقيق المصلحة العامة وتنفيذ السياسات العمومية. ونظرًا لما يطرأ من نزاعات أثناء إبرام وتنفيذ هذه الصفقات، يبرز تدخل القاضي الإداري لضمان احترام القواعد القانونية وحماية حقوق الأطراف المتعاقدة. وقد تم التطرق إلى الإطار القانوني للصفقات العمومية، واختصاصات القضاء الإداري، وآليات الفصل في النزاعات سواء في إطار القضاء الاستعجالي أو الموضوعي. وخلصت الدراسة إلى أهمية تطوير دور القاضي الإداري وتفعيل أدوات الرقابة القضائية لتحقيق شفافية ونزاهة أكبر في مجال الصفقات العمومية. Abstract: This thesis studies and analyzes the role of the administrative judge in resolving disputes arising from public procurement contracts, which are considered a fundamental legal and administrative tool for achieving the public interest and implementing public policies. Given the emergence of disputes during the conclusion and execution of these contracts, the intervention of the administrative judge becomes essential to ensure compliance with legal rules and to protect the rights of the contracting parties. The study addresses the legal framework of public contracts, the jurisdiction of the administrative judiciary, and the mechanisms for dispute resolution, whether through urgent or substantive proceedings. The research concludes with the importance of enhancing the role of the administrative judge and strengthening judicial oversight tools to ensure greater transparency and integrity in the field of public procurement. |
