ملخص الدراسة:
تتناول هذه المذكرة موضوع التقاضي الإلكتروني في القانون الجزائري المقارن، باعتباره أحد أبرز مظاهر التحول الرقمي في مجال العدالة، ووسيلة حديثة لتفسير ولوج الأفراد والمؤسسات إلى خدمات القضاء لجعله أكثر كفاءة وشفافية، وقد تم التطرق فيها إلى ما يلي: • الإطار النظري والقانوني الذي ينظم هذا النوع من التقاضي في الجزائر مع استعراض أهم الصعوبات القانونية والتقنية التي تعترضه. • دراسة التجارب المقارنة من خلال تحليل المؤرخين رائدين التجربة الفرنسية و التجربة الإماراتية مع دراسة مقارنة بينها وبين الحالة الجزائرية من حيث الإطار القانوني ومستوى التطبيق و كذا التحريات والحلول المعتمدة مواكبة التطورات في هذا المجال. Abstract: This memorandum examines the topic of electronic litigation in comparative Algerian law, considering it as one of the most significant aspects of the digital transformation within the justice sector. It serves as a modern tool to facilitate access for individuals and institutions to judicial services, with the aim of enhancing efficiency and transparency. The study is structured around two main axes: 1. Theoretical and Legal Framework in Algeria: This section explores the legal and regulatory structure governing electronic litigation in Algeria, while also identifying the key legal and technical challenges that hinder its effective implementation. 2. Comparative Analysis of International Experiences: A detailed analysis is conducted on two pioneering models - the French and Emirati experiences -highlighting their approaches to electronic litigation. A comparative evaluation is then made between these models and the Algerian system in terms of legal framework, implementation level, and the strategies adopted to address challenges and keep pace with global developments in this domain. |
