الـملخص:
تتناول هذه المذكرة بالدراسة والتحليل آليات المحاكمة المرئية في ظل قانون الإجراءات الجزائية، باعتبارها وسيلة مستحدثة تواكب التطورات التكنولوجية في ميدان العدالة، وتهدف إلى تحقيق النجاعة القضائية دون المساس بضمانات المحاكمة العادلة. وقد تطرقت الدراسة إلى الأسس القانونية للمحاكمة المرئية سواء في الاتفاقيات الدولية أو التشريعات الوطنية، مع التركيز على قانون الإجراءات الجزائية الجزائري، الذي أدرج هذه الآلية ضمن ترسانة الإصلاحات الهادفة إلى تسريع الفصل في القضايا وتخفيف العبء على المؤسسات القضائية. كما ركزت المذكرة على شروط استخدام هذه التقنية في مرحلتي التحقيق والمحاكمة، من حيث الشروط القانونية والتقنية، وكذلك بيان الجهات المخول لها تفعيلها، والإجراءات العملية لعقد الجلسات المرئية، بما في ذلك توثيق الجلسات وضمان حق الدفاع. وأخيرًا، تناولت الدراسة الآثار المترتبة على استخدام المحاكمة المرئية، لاسيما في علاقتها بمبادئ العدالة الجزائية، مثل مبدأ الوجاهية، العلنية، الشفاهية، وحق الدفاع، مؤكدة على ضرورة توخي الحذر في تطبيقها حتى لا تمس بحقوق المتقاضين. This thesis examines and analyzes the mechanisms of visual (remote) trial under the Code of Criminal Procedure, considering it an innovative tool that aligns with technological advancements in the field of justice. It aims to enhance judicial efficiency without compromising the guarantees of a fair trial. The study explores the legal foundations of visual trials, both in international agreements and national legislation, with a particular focus on the Algerian Code of Criminal Procedure, which has incorporated this mechanism as part of a series of reforms intended to accelerate case resolution and reduce the burden on judicial institutions. The thesis also focuses on the conditions for the use of this technology during the investigation and trial phases, addressing both legal and technical requirements. It clarifies the authorities authorized to implement it, and outlines the practical procedures for conducting remote sessions, including the documentation of proceedings and ensuring the right to defense. Finally, the study discusses the implications of using visual trial technology, especially in relation to the fundamental principles of criminal justice, such as the principles of adversarial proceedings, publicity, orality, and the right to defense. It emphasizes the importance of exercising caution in its application to avoid infringing on the rights of litigants. |
