الملخص
يحتل رئيس الجمهورية مكانة مرموقة في النظام السياسي الجزائري، بإعتباره هيئة الأولى في السلطة التنفيذية بموجب مختلف الدساتير الصادرة لحد الآن، كما تعد ممارسة رئيس الجمهورية دوره كسلطة ضبط إداري من خلال السلطة التنظيمية المستقلة في الظروف العادية بصفة موسعة وغير مقيدة، والتي تخوله إصدار مراسيم رئاسية لتنظيم المسائل غير المخصصة للقانون، إلاَ أنَ هذه السلطة التنظيمية تخضع لرقابة المحكمة الدستورية التي تسهر على مدى دستورية نصها التنظيمي. أما في الظروف غير العادية (الاستثنائية)، فإن مهام رئيس الجمهورية الضبطية أكثر اتساعا مقارنة بالحالات العادية، حيث تصبح كل السلطات في يده وله السلطة التنفيذية في إتخاذ الاجراءات الاستثنائية لمواجهة هذه المخاطر من إقرار لحالة الطوارئ والحصار أو الحالة الاستثنائية أو إقرار التعبئة العامة، أو حالة الحرب. الظروف العادية، الحالات الاستثنائية. Summary The President of the Republic occupies a prominent position in the Algerian political system, as the primary executive authority under the various constitutions promulgated to date. The President of the Republic exercises his role as a regulatory authority through the independent regulatory authority under normal circumstances, broadly and unrestrictedly. This authority authorizes him to issue presidential decrees to regulate matters not specifically designated by law. However, this regulatory authority is subject to the oversight of the Constitutional Court, which ensures the constitutionality of its regulatory text.
