أصبح التلوث البيئي من المشكلات الخطيرة التي باتت تواجهنا في هذا العصر، بسبب إستخدام المشآت المصنفة بوسائل صناعية وتكنولوجية متطورة الضارة بالبيئة وعدم إحترامها أساليب وقائية مما أدى إلى حدوث أضرار بالغة الخطورة يصعب تداركها أو معالجتها، وعلى هذا الأساس تم إصدار العديد من التشريعات التي توقع مسؤولية جزائية ذات طبيعة خاصة على المنشآت المصنفة،وذلك للموازنة بين متطلبات تنمية مستدامة وضمان حماية للبيئة،و يشمل ذلك اعداد استراتجية لمتابعتها و محاكمتها على المستوى الدولي والوطني. Abstract Environmental pollution has become one of the serious problems we face in this era, due to the use of classified establishments that employ advanced industrial and technological methods harmful to the environment, while failing to respect preventive measures. This has led to extremely dangerous damages that are difficult to reverse or remedy. On this basis, numerous legislations have been enacted, imposing a specific type of criminal liability on such establishments, in order to strike a balance between the requirements of sustainable development and the need to ensure environmental protection. This includes developing a strategy to monitor and prosecute these violations at both the national and international levels. |
