الملخص:
يهدف الضبط الإداري إلى حماية النظام العام من خلال منع كل ما يمكن ان يهدد امن واستقرار المجتمع. ويكون ذلك مع احترام الحقوق والحريات العامة وعدم المساس بها إلا في حدود ما يسمح به الدستور. وتستعمل هيئات الضبط الإداري سلطاتها في هذا المجال، ولكن لابد من وجود رقابة قضائية لضمان عدم تعسف في استعمال هذه السلطات وحماية حقوق الأفراد. وتزداد أهمية الرقابة خاصة في الحالات الاستثنائية وينتج عن غيابها خطر على الحريات خصوصا عندما تتوسع صلاحيات الإدارة إلى درجة قد يتم فيها تعليق بعض الأحكام الدستورية من خلال هذه الرقابة ويمكن تحقيق التوازن بين حماية النظام العام وضمان الحقوق والحريات وهو ما يساهم في تكريس دولة القانون. Abstract: Administrative policing aims to protect public order by preventing anything that may threaten the security and stability of society. This must be done while respecting public rights and freedoms, and not violating them except with in the limits allowed by the powers in this field, but judicial oversight is necessary to prevent abuse of these powers and to protect indidual rights. This oversight become even more important in exceptional situations, were the powers of the administrational provisions, posing a theat to Freedoms. Throught this oversight, a balance can be achieved between maintaining public order and guaranteeing rights and freedoms, which helps to strengthen the rule of law. |
