ملخص
انطلاقا من أهمية الطفل كمكون أساسي في المجتمع افرد المشرع الجزائري مجموعة من النصوص التي تجرم الأفعال التي تمس من عرضه وتنتهك جسده وحرمته و التي لها تأثير كبير عليه اجتماعيا ونفسيا وأخلاقيا. هذه الأفعال التي تشكل جرائم في نظر القانون باختلاف أنواعها وأشكالها كالأفعال المخلة بالحياء والاغتصاب والتحريض على الفسق والدعارة وفساد الأخلاق وكذا استغلاله في المواد الإباحية. فما مدى فعالية ونجاعة الاحكام القانونية المقررة من قبل المشرع الجزائري حماية للطفل من هذه الأفعال الماسة بعرضه وأخلاقه؟ هذا ما سنحاول تناوله في هذا البحث الموسوم ب «الحماية الجنائية للطفل من الجرائم الجنسية في التشريع الجزائري». Abstract: One of the most important elements of any society is the child. In addition to men and women, children represent a basic component that build up the community. For the crucial role the child plays, the Algerian legislator has stated as a set of legal texts that criminalize the acts which violate the child's dignity, body, sanctity. Indeed, these acts cause deep effects on child's social, psychological and even moral aspects. Moreover, these deeds are considered as crimes according to law as they differ in types and forms, such as indecent assault, rape, incitement, prostitution, moral corruption in addition to the exploitation of children Then, to what extent are the legal provisions established by the Algerian legislator effective from such acts This dissertation entitled “The Criminal Protection of Children from Sexual Crimes within Algerian Legislation” attempts to shed light on the dangers from which children are suffering and the possible solutions that help them overcome these threatening acts. |
