الملخص:
يعد الاستثمار أحد الركائز الأساسية التي اعتمدت عليها الدولة الجزائرية في رسم سياستها العامة من أجل تحقيق التنمية الاقتصادية، وتنويع موارد الدخل القومي وتحقيق التوازن الإقليمي، ويعتبر العقار الاقتصادي أحد العوامل الحيوية لجذب الاستثمار، حيث يمثل الملاذ الآمن الذي يعتمد عليه المستثمرين في إنجاز مشاريعهم، لذا عملت الدولة الجزائرية على تخصيص جزء معتبر من الأملاك الوطنية الخاصة، بهدف توجيهها كأوعية عقارية مخصصة للاستثمار. وفي هذا السياق، سن المشرع الجزائري جملة من النصوص القانونية والتنظيمية، حدد من خلالها كيفية منح واستغلال العقار الاقتصادي عن طريق آلية عقد الامتياز القابل للتنازل، قصد تشجيع واستقطاب المستثمرين الجادين، مع الحيلولة دون استنزاف هذا المورد الحساس. Abstract: Investment is one of the fundamental levers that the Algerian government has relied on to formulate its public policy, aiming to achieve economic development, diversify national income sources, and ensure territorial balance. Economic land is considered a key factor for investment attractiveness, as it serves as an essential material base for carrying out economic investment projects. This is why the Algerian state has allocated a significant portion of the national private domain to create land reserves dedicated to investment. Recognizing the strategic importance of this resource, the Algerian legislator has established a comprehensive legal and regulatory framework governing the allocation, management, and exploitation of land intended for investment through the mechanism of the transferable concession contract. This system seeks to strike a balance between facilitating access to land for serious investors and preserving a limited and sensitive national land heritage from being squandered. Résumé : L’investissement constitue l’un des leviers fondamentaux sur lesquels l’État Algérien s’est appuyé pour élaborer sa politique publique en vue de réaliser le développement économique, diversifier les resources de revenu national et assurer l’équilibre territorial. Le foncier économique est considéré comme un facteur essentiel pour l’attractivité des investissements, en tant que support matériel indispensable à la réalisation des projets économiques d’investissement, raison pour laquelle l’état Algérien a mobilisé une part importante du domaine privé national pour créer des réserves foncières dédieés a l’investissement Conscient de l’importance stratégique de cette ressource, le législateur Algérien a mis en place un arsenal juridique et réglementaire encadrant les modalités d’attribution, de gestion et d’exploitation du foncier destiné à l’investissement à travers le mécanisme du contrat de concession cessible. Ce dispositif vise à instaurer un équilibre entre la facilitation de l’accès au foncier pour les investisseurs sérieux et la préservation d’un patrimoine foncier national limité et sensible de la dilapidation. |
