ملخص
تهدف هذه المذكرة إلى دراسة تقنيات الاستجواب المستخدمة في التحقيقات الجنائية، و مدى توافقها مع مبادئ الشرعية الإجرائية. حيث فرض التقدم التكنولوجي ظهور وسائل حديثة كالاستجواب الصوتي، و تحليل الانفعالات والتعرف على الملامح، مما أثار تساؤلات حول مشروعيتها القانونية. ركزت الدراسة على تحليل الإطار القانوني الجزائري لهذه الأساليب، ومقارنته ببعض التشريعات المقارنة. كما ناقشت أثر هذه التقنيات على حقوق المتهم،خصوصا الحق في عدم الإجبار على الاعتراف والحق في محاكمة عادلة. و خلصت المذكرة إلى ضرورة تقنين استخدام هذه الوسائل لضمان حماية الحقوق دون الإضرار بكفاءة التحقيق. Abstract : This thesis aims to study the interrogation techniques used in criminal investigations and their compliance with the principles of procedural legitimacy. Technological advancements have led to the emergence of modern methods such as voice interrogation, emotional analysis, and facial recognition, raising questions about their legal legitimacy. The study focused on analyzing the Algerian legal framework for these techniques and comparing it with some comparative legislations. It also discussed the impact of these techniques on the defendant's rights, particularly the right not to be compelled to confess and the right to a fair trial. The thesis concluded that there is a need to regulate the use of these methods to ensure the protection of rights without compromising the effectiveness of investigations. |
