ملخص:
بالاعتماد على السياسة العقابية الحديثة، أولى المشرع الجزائري أهمية كبيرة لمرحلة تنفيذ الأحكام الجزائية، باعتبارها المحطة التي تجسد فيها العقوبة فعليا بعد صدور الحكم النهائي. وقد أسند مهمة التنفيذ إلى النيابة العامة، ونظمها من خلال قانون تنظيم السجون 05/04. ولتحقيق التوازن بين الردع والإصلاح، استحدث المشرع بدائل للعقوبات السالبة للحرية قصيرة المدة، كالغرامة والعمل للنفع العام. كما أدرج العقوبات التبعية ضمن العقوبات التكميلية لتبسيط النظام العقابي. وتطرقت الدراسة أيضا إلى إشكالات التنفيذ، كبيان الجهة المختصة بالنظر فيها، وشروط رفعها، وأسباب انقضاء العقوبة وفق التشريع الجزائري. Abstract: Based on the principles of modern penal policy, the Algerian legislator has given significant importance to the stage of enforcing criminal judgments, as it represents the phase where the sentence is effectively carried out following a final judgment. The task of execution has been entrusted to the Public Prosecutor's Office and is regulated through Prison Law No 05/04. To strike a balance between deterrence and rehabilitation, the legislator introduced alternatives to short-term custodial sentences, such as fines and community service. Additionally, complementary penalties have been simplified by including ancillary punishments. The study also addressed issues related to enforcement, including the competent authority to examine such matters, the conditions for raising objections, and the causes of sentence extinction under Algerian legislation. . |
