الملخص :
إن المعاهدة الدولية تمثل الحجر الأساس في المجتمع الدولي نظرا للدور الذي تلعبه في تطور القانون الدولي العام ، و تنقسم المعاهدة الدولية إلى عدة أقسام منها المعاهدات الإقليمية و المعاهدات العالمية ، و المعاهدة بالمعنى الدقيق ذات الشكل البسيط ، و المعاهدات الثنائية و المعاهدات الجماعية ، و حتى يتم إعمال بنود المعاهدات الدولية و تكون سارية النفاذ داخل إقليم الدول يجب أن تخضع للرقابة من قبل المحكمة الدستورية ، و ذلك حتى لا تكون متعارضة مع القوانين الداخلية لهذه الدولة و على سبيل الخصوص الدستور باعتباره القانون الأسمى المطبق في الدولة ، و إن هذه الرقابة التي تمارسها المحكمة الدستورية باعتبارها الهيئة المكلفة قانونا بذلك بموجب التعديل الدستوري لسنة 2020 تتم وفق إجراءات معينة بدءا بالإخطار الذي تتولى القيام به السلطة التنفيذية والسلطة التشريعية ، فالسلطة التنفيذية يمثلها رئيس الجمهورية و الوزير الأول أو وزير الحكومة حسب الحالة ، في حين أن السلطة التشريعية يمثلها مجلس الأمة أو المجلس الشعبي الوطني أو نواب البرلمان أو أعضاء مجلس الأمة . Summary : The international treaty is the cornerstone of the international community's role in the development of public international law , and the international treaty is divided into , inter alia , regional and universal treaties . The treaty is strictly in simple form , bilateral treaties and treaties are collective , In order to give effect to the provisions of international treaties and to be effective within the territory of States , they must be subject to the Constitutional Court's control. in order not to be inconsistent with the internal laws of this State and , in particular , the Constitution as the supreme law applicable in the State . This control, exercised by the Constitutional Court as the body legally mandated by the Constitutional Amendment of 2020 , is carried out in accordance with certain procedures , beginning with the notification given by the executive and the legislature . The executive branch is represented by the President of the Republic , the First Minister or the Minister of Government, The legislative power is represented by the National Assembly , the National People's Assembly , deputies of Parliament or members of the National Assembly . |
