الملخص:
في سبيل تحقيق التنمية الاقتصادية، خول المشرع الجزائري لمجموعة من الهيئات سلطة ضبط مختلف الأنشطة الاقتصادية وحماية المنافسة الحرة من مختلف الممارسات المقيدة لها، و على رأس هذه الهيئات مجلس المنافسة الذي يعتبر سلطة ضبط عامة للسوق، ويتحقق ذلك من خلال منحه جملة من الصلاحيات التنازعية والاستشارية والتنظيمية بموجب الأمر 03-03 المتعلق بالمنافسة المعدل والمتمم، وإلى جانبه توجد هيئات أخرى منحها المشرع جملة من الصلاحيات لضبط السوق المتمثلة في وزارة التجارة و سلطات الضبط القطاعية، ومن هنا تبرز العلاقة بين ضبط الأنشطة الاقتصادية وتحقيق التنمية الاقتصادية، فهذه الأخيرة مرهونة بمدى نجاعة قانون المنافسة وفعاليته في تجسيد مبادئ المنافسة الحرة في السوق بما يخدم أهداف التنمية الاقتصادية للدولة. Abstract : In order to achieve economic development, the Algerian legislator has delegated to a group of bodies the authority to control various economic activities and protect free competition from various practices that restrict them. On top of these bodies is the Competition Council, which is a general market control authority. This is achieved by granting it a number of competing, advisory and regulatory powers under Order 03-03 on amended and completed competition. Besides, there are other bodies granted by the legislator a number of powers to control the market represented by the Ministry of Commerce and the sectoral control authorities. Hence, the relationship between controlling economic activities and achieving economic development is highlighted. The latter is subject to the effectiveness of the competition law and its effectiveness in embodying the principles of free competition in the market in a way that serves the objectives of the economic development of the state. |
