ملخص:
تلعب الشركات التجارية دورا بارزا وفعالا في الرقي وباقتصاد الدولة والدفع بالتنمية، إلا من جانب آخر ترتكب الشركة أفعالا مخالفة للقانون، وبالأخص ارتكابها لجرائم معاقب عليها قانونا، لذا كان لزاما مواجهة ذلك بإقرار المسؤولية الجزائية لتوقيع الجزاء الجنائي، وباعتبار الشركات التجارية شخص معنوي، فإن النظام الجزائي يختلف عن غيرها من الأشخاص المسؤولة جزائيا، وذلك نظرا لخصوصية الجرائم المرتكبة وطبيعة المسؤولية الجزائية فيه. Abstract: Commercial companies play a prominent and effective role in the advancement of a country's economy and in driving development. However, on the other hand, companies may commit acts that violate the law, particularly crimes punishable by law. Therefore, it is necessary to address this by establishing criminal liability in order to impose legal sanctions. Given that commercial companies are legal persons, the criminal justice system treats them differently from other entities subject to criminal responsibility, due to the specific nature of the crimes committed and the particularities of corporate criminal liability. |
