ملخص:
تشكل السلطة التشريعية الركيزة الأساسية لتنظيم العلاقات القانونية داخل الدولة حيث تسند إليها مهمة إصدار القوانين التي تكفل سيادة القانون وتضمن تطبيق مبدأ المشروعية في إطار نظام مبدأ الفصل بين السلطات الذي يقرر ممارسة الهيئة التشريعية لسلطاتها بشكل مستقل بعيدا عن تدخل السلطة التنفيذية بما يحفظ التوازن بين السلطات ويحقق الرقابة المتبادلة.غير أن الواقع الدستوري الجزائري منح رئيس الجمهورية صلاحيات تشريعية واسعة سواءا من خلال المبادرة المباشرة او غير المباشرة في ظل التعديل الدستوري 2020بموجب المواد 142؛141؛154؛ والمادة 91-9. Abstract : The legislative authority constitutes the fundamental pillar for organizing legal relations within the state, as it is entrusted with the task of enacting laws that ensure the rule of law and uphold the principle of legality. This is carried out within the framework of the principle of separation of powers, which mandates the legislative body to exercise its powers independently, free from interference by the executive authority, in a manner that maintains the balance between powers and ensures mutual oversight. However, the constitutional reality in Algeria has granted the President of the Republic broad legislative powers, whether through direct or indirect initiative, particularly under the 2020 constitutional amendment, pursuant to Articles 142, 141, 154, and Article 91-9. |
