ﻣﻠﺨﺺ
ﺗﻠﻮʬت ﻋﻦ اﻟﻨﺎﲡﺔ واﻷﺿﺮار اﳌﺸﺎﻛﻞ ﻣﻦ ﺧﺎﻟﻴﺔ ﺳﻠﻴﻤﺔ، ﺑﻴﺌﺔ ﰲ اﻟﻌﻴﺶ ﺣﻘﻪ وﻣﻦ ﺑﻴﺌﺘﻪ اﺑﻦ اﻹﻧﺴﺎن ﻛﺐﻛﻮ ēﺪد وأﺻﺒﺤﺖ اﻟﻄﺒﻴﻌﻴﺔ، اﻟﺜﺮوات وﺗﺪﻫﻮر إﺳﺘﻨﺰاف إﱃ أدت واﻟﱵ وﻣﺴﺘﻤﺮة، ﺣﺎدة ﺧﻄﲑةاﻷرض ﻇﻬﻮر ﻇﻞ ﰲ ﺧﺎﺻﺔ داﳘﺔ ﲟﺨﺎﻃﺮ وأﻧﺬرت اﻟﺒﻴﺌﺔ ﻋﻠﻰ ﺳﻠﺒﺎ أﺛﺮت اﻟﻈﺎﻫﺮة ﻓﻬﺬﻩ ﻋﺎﻣﺔ، واﻟﻌﺎﱂ ﺧﺎﺻﺔ ﻋﻠﻰ ﲢﻘﻴﻘﻬﺎ وإرﺗﻜﺎز اﻟﺘﻘﻨﻴﺔ، اﳋﺼﺎﺋﺺ ﻣﻦ ﲜﻤﻠﺔ اﻷﺧﺮى اﳉﺮاﺋﻢ ʪﻗﻲ ﻋﻦ اﳌﺘﻤﻴﺰة اﻟﺒﻴﺌﻴﺔ اﳉﺮﳝﺔ ﻣﺼﻄﻠﺢ ʪﻟﻐﺔ، أﳘﻴﺔ ﻳﻜﺘﺴﻲ اﻟﺒﻴﺌﻴﺔ اﳉﺮاﺋﻢ ﻓﻤﻮﺿﻮع ﻟﺬﻟﻚ ﻗﺎﻧﻮﻧﻴﺔ، ﻛﺎنأرʪﻷﻣﺮ ﻟﻴﺲ ﻟﻠﺒﻴﺌﺔ اﻟﻜﺎﻓﻴﺔ اﳊﻤﺎﻳﺔ وﺗﻮﻓﲑ ﺳﻴﺎﺳﺔ وﺗﺒﲏ واﻟﻮﻃﻨﻴﺔ اﻟﺪوﻟﻴﺔ اﳉﻬﻮد ﺗﻈﺎﻓﺮ إﺳﺘﺪﻋﻰ اﻟﺬي اﻷﻣﺮ اﻟﻘﺎﻧﻮﻧﻴﺔ، اﻟﻨﺎﺣﻴﺔ ﻣﻦ ﺧﺼﻮﺻﺎ اﳍﲔ ﻟﻠﻤﻌﺎﻳﲑ إﺣﱰاﻣﻪ وﻋﺪم اﳌﻌﻨﻮي اﻟﺸﺨﺺ ﻧﺸﺎﻃﺎت ﻋﻦ اﻟﻨﺎﲡﺔ اﻟﺒﻴﺌﻴﺔ اﳉﺮاﺋﻢ ﰲ وʪﻷﺧﺺ ردﻋﻴﺔ، ﺟﻨﺎﺋﻴﺔ اﻟﺼﻨﺎﻋﻲ ﻓﺎﻟﺘﻄﻮر اﻟﺒﻴﺌﻴﺔ،اﻹﻗﺮار إﱃ اﳉﻨﺎﺋﻲ عʪﳌﺸﺮ دﻓﻊ ﻣﺎ ﻫﺬا اﳉﺮاﺋﻢ، ﻫﺬﻩ ﺣﺪة ﻣﻦ زاد واﻟﺘﻜﻨﻮﻟﻮﺟﻲ ﺧﻄﻮرة درﺟﺔ ﻣﻊ وﺗﺘﻨﺎﺳﺐ ʪﻟﺒﻴﺌﺔ اﻟﻼﺣﻘﺔ اﻷﺿﺮار ﻣﻊ ﺗﺘﻤﺎﺷﻰ ﺧﺎﺻﺔ ﻃﺒﻴﻌﺔ ذات ﺟﺰاﺋﻴﺔ ﲟﺴﺆوﻟﻴﺔ ﻟﻪ وﺳ ﻹﻧﺘﻔﺎﺋﻬﺎ، وﻣﻮاﻧﻊ ﻗﻴﺎﻣﻬﺎ أﺟﻞ ﻣﻦ ﺷﺮوط اﳌﺴﺆوﻟﻴﺔ ﳍﺬﻩ ﻓﻜﻴﻒ ﺗﺼﻨﻴﻔﺎēﺎ، ﺣﺴﺐ اﻟﺒﻴﺌﻴﺔ اﳉﺮاﺋﻢﳍﺎ ﻦ ﲪﺎﻳﺔ ﻟﻀﻤﺎن وﻫﺬا ʪﻟﺒﻴﺌﺔ اﻟﺼﻠﺔ ذات ﻗﺎﻧﻮﻧﻴﺔ وﻧﺼﻮص اﻟﻌﻘﻮʪت ﻗﺎﻧﻮن ﻣﻦ ﻣﺴﺘﻤﺪة ﺟﺰاﺋﻴﺔ ﻋﻘﻮʪت .ﺑﻴﺌﻴﺔ ﺟﻨﺎﺋﻴﺔ Summary Humans are the product of their environment, and they have the right to live in a healthy environment, free from the problems and harms resulting from severe, persistent, and dangerous pollution. These pollutions have led to the depletion and deterioration of natural resources and have become a threat to the planet Earth in particular and the world in general. This phenomenon has negatively impacted the environment and warned of imminent dangers, especially in light of the emergence of the term "environmental crime," which distinguishes itself from other crimes by a number of technical characteristics. Its investigation is based on legal pillars, so the issue of environmental crimes is of great importance, and providing adequate protection for the environment is not an easy matter, especially from a legal per‐ spective, which necessitated the consolidation of international and national efforts and the adoption of a deterrent criminal policy. Especially in environmental crimes resulting from the activities of legal persons and their failure to respect environ‐ mental standards, industrial and technological development has increased the se‐ verity of these crimes. This prompted the criminal legislator to recognize a special criminal liability for environmental damages, commensurate with the severity of environmental crimes according to their classification. How can this liability have conditions for its establishment and obstacles to its exclusion? Criminal penalties for it are established based on the Penal Code and legal texts related to the envi‐ ronment, in order to ensure criminal protection for the environment. |
