الملخص: محورت دراستنا حول موضوع ضمانات الاستثمار على ضوء القانون الجديد رقم 22/18 المتعلق بالاستثمار باعتبارها من المواضيع المهمة، و ذلك بتهيئة مناخ استثماري ملائم من أجل استقطاب رؤوس الأموال الأجنبية،حيث تتبع الجزائر خطى معظم دول العالم التي فتحت المجال أمام المستثمرين عن طريق توفير الحماية في جميع المجالات ، و التي تمثلت في المبادئ الأساسية التي كرسها المشرع الجزائري دستوريا مثل حرية الاستثمار و المساواة بين المستثمر لوطني و المستثمر الأجنبي، و الشفافية التي تحد من مظاهر الفساد، و الضمانات القانونية و أهمها ضمان الثبات التشريعي، الذي يعد ضمانا جوهريا في جلب المستثمرين الأجانب، ضمان حماية الملكية الفكرية، حق المستثمر الأجنبي في تحويل أمواله و عدم انتزاع ملكية مشروعه و تقديم تسهيلات مالية له كالإعفاء من إجراءات التجارة الخارجية و التوطين البنكي ، كما أولى أهمية للضمانات القضائية التي تمحورت حول اللجنة العليا الوطنية للطعون، و حقه في اللجوء للقضاء الوطني لتسوية منازعات الاستثمار أو بالطرق الودية التي تتمثل في المصالحة، الوساطة و التحكيم.
Abstract:Ourstudy emphasised the topic of investment guaranteesin light of the new lawNo 22-18on investment, considering it one of the important issues aimed at creating a favorable investment climate to attract foreign capital, Algeria is adopting the path taken by most countries around the world that have opened up to investors by providing protection in various areas. This is seen in the key principles protected by the Algerian Constitution, such as freedom of investment, equality between national and foreign investors, and transparency aimed at curbing corruption.The legal guarantees include, most importantly,the guarantee of legislative stability, which is considered a key element in attracting foreign investors, the protection of intellectual proprety, the right of foreign investors to transfer their funds, protection against the expropriation of their projects, and the provision of financial facilities sush as exemption from foreign trade procedures and banking domiciliation. In addition, particular attention has been given to judicial guarantees, notably the role of the national Higt Appeals Committee, as well as the right of the investor to resort to national courts to settle investment disputes, or to use amicable means sush as conciliation, mediation, and arbitration. |
