ملخص:
الضمانات القضائية المرتبطة بحقوق الإنسان هي من الركائز الأساسية لحماية الفرد وصون كرامته أمام السلطة. ويقوم التأطير القانوني لهذه الضمانات على نصوص دستورية وتشريعات وطنية، إلى جانب الاتفاقيات الدولية لحقوق الإنسان التي صادقت عليها الدول، مثل العهد الدولي الخاص بالحقوق المدنية والسياسية. وتشمل هذه الضمانات: الحق في المحاكمة العادلة، افتراض البراءة، المساواة أمام القضاء، وحق الدفاع. أما آليات التنفيذ فتتمثل في استقلال القضاء، إمكانية اللجوء إلى القضاء الدستوري أو الإداري، وجود مؤسسات وطنية لحقوق الإنسان، وآليات الشكاوى الفردية الدولية. وتُشكل هذه الضمانات إطارًا عمليًا لمساءلة الانتهاكات وتعزيز ثقافة العدالة والحرية. Abstract : Judicial guarantees related to human rights are fundamental pillars for protecting the individual and preserving their dignity in the face of authority. The legal framework for these guarantees is based on constitutional provisions and national legislation, as well as international human rights treaties ratified by states, such as the International Covenant on Civil and Political Rights. These guarantees include: the right to a fair trial, the presumption of innocence, equality before the courts, and the right to defense. Implementation mechanisms involve judicial independence, access to constitutional or administrative courts, the presence of national human rights institutions, and international individual complaint procedures. These guarantees provide a practical framework for addressing violations and fostering a culture of justice and freedom. |
