الملخص:
نظرا للأهمية العلمية للدليل العلمي لتفوقه على بقية أدلة الإثبات الجنائي لدقتها، هذا ما يؤثر على مبدأ تدرج الأدلة، سيؤدي الى تغليب الأدلة العلمية الحديثة عن الأدلة التقليدية، فالدليل العلمي هو الأساس التنوير طريق العدالة مما يجعل للقاضي الجنائي سلطة تقديرية في الأخذ بها أو استبعادها بناءا على اقتناعه الشخصي لما طرح أمامه في المرافعة حيث يصدر في النهاية أحكاما يقينية صادرة عن أساليب علمية فعالة، رغم هذه السلطة الواسعة الممنوحة له الا أنها تخضع لمجموعة من الضوابط والقيود لتسبيب الأحكام ومنع التعسف في استخدام السلطة. Abstract Given the scientific importance of scientific evidence and its superiority over other criminal evidence due to its accuracy, this affects the principle of gradation of evidence, which will lead to the predominance of modern scientific evidence over traditional evidence. Scientific evidence is the basis for illuminating the path of justice, which gives the criminal judge discretionary power to accept or exclude it based on his personal conviction of what was presented to him in the pleading, where he ultimately issues definitive rulings based on effective scientific methods. Despite this broad authority granted to him, it is subject to a set of controls and restrictions to justify rulings and prevent the abuse of power. |
