الملخص :
تلعب المحكمة الدولية لقانون البحار دوراً حيوياً في حماية البيئة البحرية من خلال تطبيق أحكام اتفاقية الأمم المتحدة لقانون البحار و مراقبة الإلتزام الدولي بالقوانين البيئية المتعلقة بالبحار ، حيث تختص هذه المحكمة بالفصل في المنازعات البحرية الدولية المتلفة و المتنوعة .حيث من بين الإختصاصات الممنوحة لها بموجب القانون الدولي للبحار ، نجد تولي فصلها في المنازعات التلوث البحري مساهمة منها في حماية البيئة البحرية و الحفاظ عليها و مواجهة التلوث البحري . و من ثم فإن دراستنا تتمحور حول مساهمة المحكمة الدولية للبحار في حماية البيئة البحرية من التلوث و ضمان سلامتها وفق ما تقتضي به أحكام القانون الدولي للبحار و نظامها الأساسي المدرج في اتفاقية قانون البحار لعام 1982 . Summary : The Intenational tribunal for the law of the Seaplays a central role in protecting the marine environmentthroug the application of the provisions of the United Nation convention on the Law of the Sea and the monitoring of compliancewith international lawrelating to the protection of the marine environment . this tribunal has jurisdiction to resolve international disputes relating to the sea ,which are oftencomplex and varied . Among the jurisdictionsconferreduponitunder the international law of the se ais the settlement of disputes relating to marine pollution , whichconstitutes a significant contribution to the protection and perservantion of the marine environment , as well as to combating marine pollution . thus , ourstudyfocuses on the contribution of the international tribunal for the law of the sea to protection the marine environmentaganist pollution and ensuringitssafety . In accordance with the provisions of international law of the sea and itsstatus as enshrined in the 1982 united nations convention on the law of the sea . |
