ملخص الدراسة:
يمثل الحق في البيئة أحد الحقوق الأساسية التي كرّستها الدساتير الجزائرية، لاسيما في التعديلات الأخيرة التي نصت صراحة على هذا الحق في إطار التنمية المستدامة. ويُظهر هذا التطور الدستوري مدى إدراك الدولة لأهمية حماية البيئة كعنصر محوري لضمان حياة كريمة للمواطنين. لكن رغم وجود هذا الحق على المستوى الدستوري، تبقى فعالية حمايته مرتبطة بمدى تفعيل الآليات القانونية، والمؤسساتية، والرقابية، وكذا بتعزيز الوعي البيئي لدى المواطنين. ومن ثم، فإن التحدي الحقيقي لا يكمن في الاعتراف بالحق فقط، بل في تجسيده فعلياً على أرض الواقع من خلال تطبيق صارم للقوانين، وتعاون جميع الفاعلين من دولة ومجتمع مدني ومواطنين. STUDY SUMMARY: The right to the environment is one of the fundamental rights enshrined in Algerian constitutions, particularly in recent amendments that explicitly included this right within the framework of sustainable development. This constitutional development demonstrates the state's awareness of the importance of environmental protection as a pivotal element in ensuring a decent life for citizens. However, despite the existence of this right at the constitutional level, the effectiveness of its protection remains dependent on the effectiveness of legal, institutional, and oversight mechanisms, as well as on enhancing environmental awareness among citizens. Therefore, the real challenge lies not only in recognizing the right, but in actually implementing it on the ground through strict implementation of the law and the cooperation of all stakeholders, including the state, civil society, and citizens. |
