ملخص المذكرة: أثر العقوبة الجزائية على مسار الموظف العام
تضمنت هذه الدراسة بيانا مفصلا حول ماهية الموظف العام، من خلال استعراض المفاهيم التشريعية والفقهية والقضائية المتعلقة به، كما تم التطرق إلى المسؤولية التأديبية والجزائية التي قد يتعرض لها الموظف و الطبيعة القانونية لجريمة الموظف العام، بالإضافة إلى عرض أوجه الاختلاف والتشابه بينهما ، مع بيان شروط وحجية الحكم الجنائي في المجال التأديبي، مع التركيز على النصوص الواردة في الأمر رقم 06-03 وضمانات تأديب الموظف ، خلصت الدراسة إلى أن الحكم الجنائي يؤثر بشكل مباشر على الوضعية الوظيفية للموظف، مع وجود قصور تشريعي في تنظيم العلاقة بين المساءلتين، مما يستدعي تطوير الإطار القانوني وضمان حقوق الموظف. Summary This study provides a detailed explanation of the concept of the public employee by reviewing the related legislative, doctrinal, and judicial concepts. It also addresses the disciplinary and criminal liability that the employee may face and the legal nature of offenses committed by public employees. The study highlights the similarities and differences between these two types of liability and explains the conditions and binding effect of criminal judgments in the disciplinary field, with particular focus on the provisions of Decree No. 03-06 and the guarantees for disciplining employees. The study concludes that criminal judgments have a direct impact on the employee’s job status, while noting legislative shortcomings in regulating the relationship between the two types of accountability, which necessitates the development of a legal framework and the safeguarding of employee rights. |
