الملخص:
تتناول هذه الدراسة المعيقات القانونية المرتبطة باستخدام تقنية الذكاء الاصطناعي انطلاقا من توضيح الإطار المفاهيمي والتنظيم لهذه التكنولوجيا المتقدمة، وتطورها المتسارع في مختلف القطاعات. تتطرق الدراسة إلى إشكالية غياب إطار قانوني واضح ينظم استخدام الذكاء الاصطناعي، خاصة في التشريعات العربية، وتناقش مدى إمكانية الاعتراف له بالشخصية قانونية، إضافة إلى صعوبة تحديد المسؤولية القانونية عند وقوع أضرار، كما تركز على قضايا الخصوصية، والتحيز الخوارزمي، وغياب الشفافية في عمل الخوارزميات، إلى جانب التحديات الأخلاقية الناجمة عن قرارات آلية قد تؤثر على حقوق الأفراد. كما تلخص الدراسة إلى ضرورة تحديث المنظومات القانونية، وبلورة إطار تشريعي متكامل يوازن بين التطور التقني وحماية الحقوق الأساسية Abstract: This study addresses the legal obstacles associated with the use of artificial intelligence (AI) technology, beginning with clarifying the conceptual and regulatory framework for this advanced technology and its rapid development across various sectors. The study addresses the lack of a clear legal framework regulating the use of AI, particularly in Arab legislation, and discusses the possibility of recognizing AI as a legal entity. It also discusses the difficulty of determining legal liability in the event of damages. It also focuses on privacy issues, algorithmic bias, and the lack of transparency in algorithmic operations, along with the ethical challenges arising from automated decisions that may impact individual rights. The study also concludes with the need to modernize legal systems and develop an integrated legislative framework that balances technological development with the protection of fundamental rights. |
