الملخص:
لنظر للأهمية المتزايدة لمبدأ الاحتياط كآلية وقائية في مجال حماية المستهلك، لاسيما في ظل تعقيد المخاطر المرتبطة بالمنتجات والخدمات الحديثة، كرس المشرع الجزائري هذا المبدأ بشكل صريح بصدور القانون رقم 09-03 المتعلق بحماية المستهلك وقمع الغش المعدل والمتمم، كما دعمه بالمرسوم 12-203 المتعلق بالقواعد المطبقة في مجال أمن المنتوجات. وبمقتضى ذلك منح المشرع لأعوان قمع الغش صلاحيات واسعة للكشف عن مخاطر المنتجات التي يشتبه في عدم مطابقتها للمقاييس والمواصفات القانونية وكذا متطلبات أمن المنتوجات، بهدف التصدي لها من خلال تطبيق تدابير تحفظية لمصلحة المستهلك. Abstract Given the increasing importance of the precautionary principle as a preventive mechanism in the field of consumer protection, especially in light of the complexity of the risks associated with modern products and services, the Algerian legislator explicitly enshrined this principle with the promulgation of Law No. 09-03 on consumer protection and the suppression of fraud, as amended and supplemented, as supported by Decree No. 12-203 on the rules applicable in the field of product security. Accordingly, the legislator granted the agents of fraud repression wide powers to detect the risks of products that are suspected of not conforming to the standards, legal specifications, and product security requirements, with the aim of addressing them through the application of precautionary measures in the interest of the consumer. |
