تم إنشاء المحكمة الدستورية بموجب التعديل الدستوري لسنة 2020، حيث أَوكَل إليها المؤسس الدستوري مهمة السهر على احترام الدستور وضمان حسن سير المؤسسات ونشاط السلطات العمومية في إطار سعيه لتعزيز استقرار هذه المؤسسات واستكمال البناء المؤسساتي لدولة الحق والقانون. تهدف هذه الدراسة إلى إبراز دور المحكمة الدستورية في تحقيق استقرار السلطات والمؤسسات الدستورية من خلال صلاحياتها في الفصل في النزاعات التي قد تنشأ بينهما، والإشراف على ضبط نتائج الانتخابات، فضلا عن مهامها الاستشارية في الحالات الاستثنائية بما يعزز من استمرارية واستقرار المنظومة المؤسساتية للدولة. Abstract : The Constitutional Court was established by virtue of the 2020 constitutional amendment. The founder entrusted it with the task of ensuring respect for the constitution and ensuring the proper functioning of institutions and the activity of public authorities, as part of his efforts to enhance the stability of these institutions and complete the institutional structure of the state of law and justice. This study aims to highlight the role of the Constitutional Court in achieving the stability of constitutional authorities and institutions through its power to adjudicate disputes that may arise between them, supervise the control of election results, and carry out its advisory duties in exceptional cases, thus enhancing the continuity and stability of the state’s institutional system. |
