الملخص :
نظرا لانتشار الجرائم الجمركية على نطاق واسع، بات من الضروري أن يعتمد جهاز الجمارك تطبيقا صارما للقوانين والتنظيمات ذات الصلة، بهدف التصدي بفعالية لهذا النوع من الجرائم التي باتت تشكل تهديدا حقيقيا للاقتصاد الوطني ،ولا شك أن التعامل مع الكم الكبير من القضايا المرتبطة بهذه الجرائم يشكل تحديا كبيرا للجهات القضائية، ونظرا إلى طبيعة هذه الجرائم وخصوصيتها، أقرّ المشرع "المصالحة الجمركية" كآلية بديلة لحل النزاعات بطريقة ودية، بعيدا عن تعقيدات الإجراءات القضائية وقد ساهم هذا الإجراء، من جهة في تسهيل تسوية النزاعات، ومن جهة أخرى، في تخفيف العبء عن الجهاز القضائي وقد عرفت المصالحة الجمركية تطورا ملحوظًا لاهتمام المشرع بهذه الالية وفقا للقوانين و التنظيم ، لكن رغم ذلك يبقى التحدي الأكبر في ضمان توازن فعّال بين حماية الاقتصاد الوطني وضمان احترام حقوق الأطراف . Resume Given the widespread prevalence of customs-related crimes, it has become imperative for the Customs Authority to strictly enforce relevant laws and regulations in order to effectively combat this type of crime, which poses a serious threat to the national economy. With the increasing number of cases related to such offenses, the judicial system faces significant challenges in handling them through conventional legal procedures, due to their complexity and time-consuming nature. In response, the legislator introduced “customs reconciliation “as an alternative mechanism for resolving disputes amicably, avoiding the complications of judicial proceedings. This measure has not only facilitated the settlement of disputes but has also helped alleviate the burden on the judiciary. Customs reconciliation has witnessed notable development, reflecting the legislator's growing interest in this mechanism within the framework of existing laws and regulations. However, the greatest challenge remains achieving an effective balance between protecting the national economy and ensuring respect for the rights of all parties involved |
