الملخص باللغة العربية :
تعتبر الحرية الشخصية من الحقوق الأساسية التي يكفلها الدستور الجزائري؛ وقد خصص المشرع العديد من الضمانات القانونية لحمايتها من أي انتهاك. ومن أبرز هذه الضمانات حماية الحرية الشخصية خلال مرحلة التحقيق القضائي ، وهي المرحلة التي يتولى فيها القضاء والسلطات الأمنية اجراء التحريات والبحث في القضايا الجنائية. يتم خلالها اتخاد عدة تدابير للقبض على المتهمين والتحقيق معهم.، ما يتطلب ضمانات قانونية تحمي الشخص من أي تعسف قد يتعرض له اثناء هذه الاجراءات، كما تعتبر مرحلة التحقيق القضائي ذات أهمية خاصة لأنها تشهد تداخلا بين حماية حقوق الأفراد من جهة وواجب السلطات القضائية في كشف الحقيقة من جهة أخرى ومن أجل تحقيق التوازن بين الحقوق والحريات العامة سعى المشرع الى سن القوانين التي تضمن عدم المساس بحرية الأفراد ونظم الضوابط الاجرائية التي تكفل الحماية الجنائية للحرية الشخصية في مرحلة التحقيق القضائي. ملخص باللغة الأجنبية : Personal freedom is one of the fundamental rights guaranteed by the Algerian Constitution. To protect this right from any potential violation, the legislator has put in place various legal safeguards, particularly during the judicial investigation phase. This critical stage involves law enforcement and the judiciary conducting inquiries into criminal cases, including arresting suspects and gathering evidence. Given the potential for misuse of power in such circumstances, strong legal protections are essential to prevent any form of abuse. The judicial investigation phase holds special importance as it requires balancing two often competing interests: safeguarding individual rights and fulfilling the state's duty to uncover the truth. To maintain this delicate balance, the legislator has established procedural safeguards to protect personal freedom during this stage, ensuring that the rights of individuals are respected while allowing the judicial system to function effectively . |
