باللّغة العربية:
على ضوء الأهمّية المحورية للاستثمار في دفع عجلة التّنمية الاقتصادية، تبنّت الجزائر سلسلةً مِنَ الإصلاحات الاقتصادية الجديدة الهادفة إلى ترسيخ مبدأحُرية الاستثمار، وَقد تجلّت هذه الإصلاحات في تكريس هذا المبدأعبْر مراحلٍ تاريخيّةٍ بداية من الانفتاح الاقتصاديّانطلاقًا مِنَ التّسعينات لِلقرن الماضي،فسعى مِنْ خلالها لِتحقيق التّوازن الدقيق بين مصالح المستثمرين الخاصة، والمصلحة العامة، وَتماشيًّا مع هذا التّوجّه أقر المشرع الجزائري حماية قانونية، وَضمانات وَحوافز مُتنوّعة، ممّا يعكس التزام الدّولة بِتهيِئة بيئة استثمارية جاذبة، إذْ يُعدّ انفتاح النّظام الاقتصاديّ وَتبنّي سياسات التحرير شرطين جوهريْن لِجذب رُؤوس الأموال، وَمع ذلك لم يغفلِ المشرّع ضرورة فرض قيود وضوابط محددة لضمان انسجام الممارسات الاستثمارية مع الأهداف التّنمويَة العليا للدولة وَحماية القطاعات الاستراتيجيّة مِنَ المخاطر المحتملة، وَتوفيرُ مناخٍ استثماريٍّ متوازن يجمع بين الحرية الاقتصادية والرقابة القانونية. Summary: In light of the pivotal importance of investment in driving economic development, Algeria has adopted a series of new economic reforms aimed at consolidating the principle of investment Freedom. These reforms have been manifested in the consecration of this principle through historical stages, beginning with economic openness starting from the 1990s. Through this, it sought to achieve a delicate balance between the private interests of investors and the public interest. In line with this trend, the Algerian legislator has established legal protection, guarantees. and various incentives, reflecting the antees the State's commitment to Creating an attractive investment environment, as the openness of the economic system and the adoption of liberalization policies are two essential conditions for attracting capital. However, the legislator did not reglect the need to impose specific vestvictions and controls to ensure that investment practices are Consistent with the state's higher development goals, protect strategicsectors from potential risks, and provide a blanced investment. climate that combines economic freedom and legal oversight. |
