يواجه نظام المسؤولية صعوبات في تعويض الأضرار البيئية، خاصة فيما يتعلق با تغطيةأضرر وتحديد المسؤول. لذلك، اعتمدت بعض التشريعات صناديق خاصة للتعويض تعتمد على مبدأ التأمين الإجباري، وتموَّل من الجهات الملوثة أو من مساهمات إلزامية. وتختلف أدوار هذه الصناديق بين تغطية الأضرار غير المؤمَّنة والتعويض الكامل عند الضرورة، لكنها تخضع لسقوف مالية ولا تشمل بعض الحالات، مثل الخطأ الجسيم من المتضرر أو السلوك المتعمد من الملوّث.
Smury: The responsability system faces many difficulties in componsation of the environmental damage, particularly with regard to damage coverage and identifying responsibility. Therefore, some legislation has adopted special compensation funds based on the principle of compulsory insurance, financed by polluters or through mandatory contributions. The roles of these funds vary from covering uninsured damages to full compensation when necessary. However, these funds are subjet to financial ceilings and does not cover certain cases, such as gross negligence on the part of the injured party or intentional conduct from the part of the polluter |
