ملخص :
أولت الجزائر أهمية بالغة للاستثمار ، باعتباره عامل استراتيجي في دفع عجلة التنمية الاقتصادية، فأقرت لع العديد من النصوص القانونية المتعاقبة ، والتي حملت في طياتها جملة من الضمانات والمزايا للمستثمرين المحليين و الأجانب على حد سواء ، آخرها القانون رقم 22-18 المتعلق بالاستثمار، الذي عمل من خلاله المشرع على استحداث أنظمة تحفيزية تتماشى مع الخطط التنموية للدولة، و قد استحدث المشرع مجموعة من الأنظمة التحفيزية التي كان لها دور كبير في استقطاب الاستثمار الأجنبي، كما أقر لها مجموعة من الإجراءات كاستحداث المنصة الرقمية ، والشبابيك الوحيدة اللامركزية فنجد أن المشرع الجزائري قد استقر على ما جاءت به التشريعات السابقة للاستثمار وقد استحدث مجموعة من الضمانات لاسيما منها المتعلقة بالملكية الفكرية، منح امتياز على أراضي الدولة،أما فيما يخص الضمانات القضائية فيعتبر المشرع الجزائري أن الأصل في التقاضي هو اختصاص للقضاء الوطني. أما في حالة وجود اتفاقيات ثنائية أو متعددة الأطراف فيمكن للمستثمر اللجوء الى الطرق البديلة لفض النزاعات (المصالحة، الوساطة، التحكيم). Abstract : Algeria has gave a great importance to investment, as a strategic factor in advancing economic development , So it approved many successive legal texts for, which carried a number of guarantees and benefits for both national and foreign investors.The latest of which was law No. 22/18 related to investment, vreated incentive systems thas are in line whith the development plans of the state, The legislator has introduced a set of incentive systems that have played a significant role in attracting foreign investment. In addition, several measures have been adopted, such as the creation of a digital platform and decentralized one-stop windows. It is evident that the Algerian legislator has maintained the core principles of previous investment legislations while also introducing a range of guarantees, particularly those related to intellectual property and the granting of concessions on state-owned land. As for judicial guarantees, the Algerian legislator considers that the primary jurisdiction for litigation lies with the national judiciary. However, in the presence of bilateral or multilateral agreements, investors may resort to alternative dispute resolution methods (conciliation, mediation, arbitration). |
