الملخص :.
يتميز العالم التجاري بخاصيتي السرعة والائتمان، ولهذا فقد تطور بمرور الزمن خاصة مع التطورات التكنولوجية التي أصبحت تغزو العالم ، وبسبب هذه التطورات بدأت تنشأ منازعات تتسم بالصعوبة والتعقيد بين التجار ، فحاولت الدول من خلال تشريعاتها ومنظومتها القانونية مواكبة هذه التطورات بالتوجه نحو قضاء متخصص للفصل في هذه المنازعات و قد تأثر المشرع الجزائري بالتشريعات المقارنة وبدأت تتكون لديه فكرة القضاء المتخصص منذ إصداره لقانون الإجراءات المدنية والإدارية في 2008 عندما نص على ضرورة استحداث الأقطاب القضائية المتخصصة للفصل في المنازعات التجارية ،لكنها لم تجسد على ارض الواقع ،وبعد التطورات الراهنة الأخيرة و المحاولات التي تسعى اليها المنظومة الجزائرية لترقية الاستثمار استحدث المشرع الجزائري محاكم متخصصة للفصل في المنازعات التجارية المعقدة و أطلق عليها تسمية "المحاكم التجارية المتخصصة ". Summary: The commercial world is distinguished by itsrapidpace and reliance on credibility, and has undergonesignificantevolution over time, driven by technologicaladvancements. This evolution has givenrise to complex and challenging disputes between traders. In response, countries have sought to adapttheirlegislative and judicial frameworks to accommodatethesedevelopments, with a focus on establishingspecialized courts to resolve commercial disputes. The Algerian legislator, drawing inspiration from comparative legislation, has been exploring the concept of specialized courts since the enactment of the 2008 Civil and Administrative ProceduresLaw. Although the lawprovided for the establishment of specializedjudicial divisions to handle commercial disputes, this provision was not implemented in practice. However, in light of recentdevelopments and efforts to enhanceinvestment, the Algerian legislator has nowestablishedspecialized courts, designated as "Specialized Commercial Courts", to resolvecomplex commercial disputes. |
