Résumé
La saisie est une mesure d'enquête et de sécurité. Il s'agit d'une mesure effective accordée par le législateur algérien aux officiers de police judiciaire pour un motif légitime, dans le but de prévenir ou d'enquêter sur des infractions. C'est une mesure qui porte atteinte à la liberté de circulation des individus. Puisque cette règle exige l'exercice du droit à un équilibre entre le droit de la société à punir et le droit des individus au respect de leurs libertés, la loi stipule les droits de la personne saisie (substantiels et procéduraux) et met l'accent sur leur respect et leur non-violation. Abstract: Apprehending is one of the procedures for investigating and maintaining security. It is an effective procedure granted by the Algerian legislator to judicial officers for a legitimate reason, with the aim of preventing crimes or in the context of investigating them. It is a dangerous procedure for the individual’s freedom of movement, and since the rule requires the necessity of implementing the right to balance the right of society. In imposing punishment, and the right of people to have their freedoms respected, the law stipulates the rights of the detainee (substantive, procedural) and emphasizes their respect and non-aggression |
