إنَّ مبدأ الـحيطة في الـمجال البيئي، هو أن يتم اتـخاذ التدابير الوقائية الضرورية من أجل تفادي وقوع الأضرار بالبيئة أوالتقليل من تدهورها وذلك في ظل غياب اليقين العلمي، وهذا ما جسده الـمشرع الـجزائري في القانون 03-10 والنصوص الـمطبقة له في مـجموعة الإجراءات الوقائية من عقود التعمير ورخص استغلال الـمنشآت، وبالتالي فهذا كله أدى بالدول إلى تبني مبادئ جديدة لتكريس حـماية البيئة أهـهمها مبدأ الـحيطة ودوره الفعّال في حـماية البيئة في التشريع الـجزائري، كما أنَّه إجراء يطبق عندما تكون الأسباب غير كافية لوقوع أضرار جسيمة تؤثر على البيئة، بالإضافة إلى تقييم شروطه الّتي تـجعل منه مـحورًا قابلا للتطبيق من حيث تفعيله، وتوضيح نطاقه القانوني في التشريع الـجزائري قصد مواجهة التعقيد وعدم اليقين في إدارة مـخاطر البيئة.
وعليه فإنَّ معظم الدول ومن بينها الـجزائر كرست مبدأ الـحيطة في عدة نصوص قانونية تنص على احترامه ووضعت قوانين خاصة لـمخالفي هذا الـمبدأ وذلك حفاظًا على البيئة وتـحقيقًا للتنمية الـمستدامة. The precautionary principle in the environmental field dictates that necessary preventive measures be taken to avoid environmental damage or minimize its degradation in the absence of scientific certainty. This principle is embodied by the Algerian legislator in Law 03-10 and its implementing regulations, which encompass a set of preventive measures related to construction contracts and operating licenses. Consequently, this has led countries to adopt new principles for enshrining environmental protection, most notably the precautionary principle and its effective role in environmental protection within Algerian legislation. Furthermore, it is a measure applied when the reasons for serious environmental damage are insufficient. The evaluation of its conditions, which make it a viable framework for implementation, and the clarification of its legal scope within Algerian legislation are crucial for addressing the complexity and uncertainty in environmental risk management. Therefore, most countries, including Algeria, have enshrined the precautionary principle in several legal texts stipulating its respect and have established specific laws for those who violate this principle, all in order to protect the environment and achieve sustainable development. |
