This subject has sparked extensive debate in both legal jurisprudence and judicial rulings, especially in light of the evolution of medical liability. Consequently, a medical contract cannot be concluded without the presence of the element of consent. However, there are exceptions where a physician may bypass the limits of patient consent in specific cases strictly defined by the legislator under Health Law 18-11. To reinforce the physician's responsibility toward the patient, the legislator has established legal procedures and sanctions imposed on practitioners in cases of non-compliance with the ethics of this honorable profession, in accordance with the Penal Code and Executive Decree 92-276, in addition to the Health Law. |
