فرضالتطوراالقتصاديوالتحول القائم علىالصناعةوالتكنولوجيااحلديثة،التوجهإىل مسؤوليةأوسعنطاقامناملسؤولية القائمةعلىاخلطأ،هبدف البحثعنحتقيق عدالةللمضرورين يفحالانتفاءاخلطأأوصعوبةإثباته،هذاالتوجهاجلديدجسدتهنظريةاملسؤوليةاملوضوعيةأوما يسمىبتحملالتبعةكمسؤوليةقائمة علىفكرةالضرروليساخلطأ. وقد عاجلت الدراسةع اجلزائري يف األخذ ابالجتاه املومدى توفيق املشرضوعي للمسؤولية املدنية وبعض تطبيقات هذه املسؤولية. Abstract: As a result of economic development and the shift brought about by modern industry and technology, the trend has moved toward a form of liability that is broader in scope than the liability based on fault. The aim is to achieve justice for injured parties where fault is absent or where proving it is difficult. This new direction is embodied in the theory of objective liability, or what is commonly referred to as assumption/transfer of liability as a liability founded on harm rather than on fault.” The study examines the extent to which the Algerian legislator has aligned with the objective approach to civil liability, as well as certain applications of this liability. |
