الـملخص: تتناول هذه المذكرة موضوع جرائم المساس بالاستثمار في التشريع الجزائري، مع التركيز على الأحكام المستحدثة في القانون 24-06، حيث سعت الدراسة إلى إبراز مفهوم الاستثمار وأهميته الاقتصادية، ثم توضيح الجرائم التي تهدد مناخ الاستثمار وتؤثر على التنمية الاقتصادية، سواء تعلق الأمر بجرائم الفساد الإداري كالرشوة واستغلال النفوذ وعرقلة الاستثمار، أو الجرائم المالية والتجارية مثل غسل الأموال والتهرب الضريبي والجرائم المالية الإلكترونية. كما عالجت الدراسة الأركان القانونية لجريمة المساس بالاستثمار من خلال بيان الركن الشرعي والمادي والمعنوي، إضافة إلى توضيح السياسة العقابية التي اعتمدها المشرع الجزائري في مواجهة هذه الجرائم، من خلال العقوبات الأصلية والمشددة وتدابير الحماية القانونية للاستثمار. وخلصت الدراسة إلى أن حماية الاستثمار تتطلب منظومة قانونية صارمة وآليات رقابية فعالة لضمان تحقيق الأمن الاقتصادي وتشجيع الاستثمار الوطني والأجنبي.
Abstract: This dissertation addresses the subject of crimes affecting investment in Algerian legislation, with a focus on the new provisions introduced by Law 24-06. The study sought to highlight the concept of investment and its economic importance, then clarify the crimes that threaten the investment climate and affect economic development, whether related to administrative corruption crimes such as bribery, abuse of influence, and obstruction of investment, or financial and commercial crimes such as money laundering, tax evasion, and electronic financial crimes. The study also examined the legal elements of the crime of affecting investment by explaining the legal, material, and moral elements, in addition to clarifying the punitive policy adopted by the Algerian legislator in confronting these crimes through original and aggravated penalties, as well as legal protection measures for investment. The study concluded that protecting investment requires a strict legal system and effective oversight mechanisms to ensure economic security and encourage both national and foreign investment. |
