ملخص:
نظام التراخيص المنجمية هو مجموعة من القواعد القانونية التي تنظم منح الاستغلال والبحث عن الثروات المعدنية بما يضمن التوازن بين التنمية الاقتصادية وحماية البيئة. تخضع عمليات الاستغلال المنجمي لإجراءات إدارية صارمة تبدأ بالحصول على التراخيص المسبقة من الجهات المختصة. يهدف هذا النظام إلى استغلال الموارد الطبيعية بشكل عقلاني يمنع الاستنزاف العشوائي للثروات الباطنية. كما يفرض التزامات بيئية على أصحاب التراخيص تشمل احترام معايير السلامة وتقليل التلوث وإعادة تأهيل المواقع بعد الاستغلال. وتبرز العلاقة بين التراخيص المنجمية وحماية البيئة من خلال اشتراط الدراسات البيئية قبل منح أي ترخيص. ويُعد مبدأ التنمية المستدامة الإطار المرجعي الذي يربط بين النشاط المنجمي والحفاظ على التوازن البيئي. وبذلك يسعى النظام إلى تحقيق توازن بين استغلال الثروات الطبيعية وضمان حماية البيئة للأجيال القادمة. كلمات مفتاحية: التراخيص المنجمية، حماية البيئة، الاستغلال المنجمي، التنمية المستدامة، الدراسات البيئية، الموارد الطبيعية، التشريع البيئي. Abstract : The mining licensing system is a set of legal rules governing the granting of permits for the exploration and exploitation of mineral resources, ensuring a balance between economic development and environmental protection. Mining operations are subject to strict administrative procedures, beginning with the acquisition of prior permits from the competent authorities. This system aims to ensure the rational exploitation of natural resources, preventing the indiscriminate depletion of mineral resources. It also imposes environmental obligations on licensees, including compliance with safety standards, pollution reduction, and site rehabilitation following exploitation. The relationship between mining licenses and environmental protection is highlighted by the requirement for environmental studies prior to the granting of any license. The principle of sustainable development serves as the framework linking mining activities to the preservation of ecological balance. Thus, the system seeks to strike a balance between the exploitation of natural resources and ensuring environmental protection for future generations.
