ملخص:
تناولت هذه المذكرة دراسة الدور التشريعي للغرفة الثانية في كل من البرلمان الجزائري والمغربي، من خلال مقارنة بين مجلس الأمة الجزائري ومجلس المستشارين المغربي. وركزت الدراسة على أسباب تبني نظام الثنائية البرلمانية في البلدين، سواء السياسية أو القانونية أو الاقتصادية والاجتماعية. كما عالجت كيفية تشكيل وتنظيم الغرفة الثانية في كلا النظامين، مع بيان اختصاصاتها التشريعية وآليات عملها داخل البرلمان. وتطرقت كذلك إلى دور هذه الغرف في تحسين جودة التشريع وتحقيق التوازن بين السلطات وتوسيع التمثيل السياسي. وخلصت الدراسة إلى أن الغرفة الثانية تسهم في تدعيم الاستقرار السياسي ورفع كفاءة العمل البرلماني، رغم وجود بعض القيود التي تحد من فعاليتها التشريعية في الواقع العملي. Abstract: This thesis examines the legislative role of the second chamber in both the Algerian and Moroccan parliaments, comparing the Algerian Council of the Nation and the Moroccan House of Councillors. The study focuses on the reasons for adopting a bicameral parliamentary system in both countries, whether political, legal, economic, or social. It also addresses the formation and organization of the second chamber in both systems, outlining its legislative powers and mechanisms of operation within parliament. Furthermore, it explores the role of these chambers in improving the quality of legislation, achieving a balance of power, and broadening political representation. The study concludes that the second chamber contributes to strengthening political stability and enhancing the efficiency of parliamentary work, despite certain limitations that restrict its legislative effectiveness in practice |
