ملخص:
يتناول التشريع الجزائري موضوع **النفايات الإلكترونية** من خلال إطار قانوني يهدف إلى حماية البيئة والصحة العامة. ركز المشرّع الجزائري على تنظيم جمع، نقل، معالجة، وتدوير النفايات الإلكترونية، خاصةً في ضوء تزايد المخاطر المرتبطة بها. صدرت عدة قوانين وقرارات وزارية لضبط التصرف في هذه النفايات، أبرزها القانون رقم 01-19 المتعلق بتسيير النفايات ومراقبتها. ألزم المشرّع المنتجين والمستوردين بتحمل جزء من مسؤولية إدارة النفايات الإلكترونية، مع تشجيع إعادة التدوير وإدماج القطاع الخاص في عمليات الجمع والمعالجة. كما يفرض القانون عقوبات على المخالفين للضوابط البيئية. رغم ذلك، ما زالت التحديات قائمة بسبب نقص الوعي وضعف البنية التحتية. يبقى تطوير الإطار التشريعي والممارسات التطبيقية ضرورة لمواكبة تطور تكنولوجيا المعلومات. Abstract: Algerian legislation addresses the issue of **electronic waste** thru a legal framework aimed at protecting the environment and public health. The Algerian legislator focused on regulating the collection, transportation, treatment, and recycling of electronic waste, especially in light of the increasing risks associated with it. Several laws and ministerial decisions have been issued to regulate the management of these wastes, the most notable being Law No. 01-19 concerning waste management and monitoring. The legislator obligated producers and importers to bear part of the responsibility for managing electronic waste, while encouraging recycling and integrating the private sector into collection and processing operations. The law also imposes penalties on those who violate environmental regulations. Despite that, challenges still persist due to a lack of awareness and weak infrastructure. The development of the legislative framework and practical practices remains essential to keep pace with the advancement of information technology. |
