تناكلت ىذه الدراسة موضوع األطراؼ ادلتعاقدة كادلساعدة يف عقود التجارة الدكلية، من
يف ىذه العقود، سواء من خالؿ نخالؿ إبراز الدكر الذم تؤديو الدكلة باعتبارىا طرفنا فاعال شلارستها المتيازات السلطة العامة أك تصرفها كشخص قانوين رلرد من تلكاالمتيازات. كما مت كات متعددة اجلنسيات كاألفراد باعتبارىم أطرافنا مؤثرة يف العالقات التعاقديةالتطرؽ إىل دكر الشر كتهم كاحلماية القانونية ادلقررة ذلم. كما تناكلت الدراسة اذليئاتالدكلية، مع توضيح طبيعة مشار الدكلية كالوطنية اليت تؤطر عقود التجارة الدكلية، إضكاتافة إىل اجلهات ادلساعدة كالبنوؾ كشر النقل كالتأم ُت كدكرىا يف تسهيل تنفيذ العقود كضماف استقرار ادلعامالت التجارية الدكلية. كقد خلصت الدراسة إىل أف صلاح عقود التجارة الدكلية يرتبط ٔتدل التكامل كالتنسيق ب ُت سلتلف األطراؼ ادلتدخلة كاجلهات ادلساعدة لتحقيق األمن كاالستقرار القانوين كاالقتصادم This study examined the topic of contracting and supporting parties in international trade contracts by highlighting the role played by the state as an active party in such contracts, whether through exercising public authority privileges or acting as a legal entity without those privileges. The study also addressed the role of multinational companies and individuals as influential parties in international contractual relations, while clarifying the nature of their participation and the legal protection granted to them. Furthermore, the study explored international and national institutions that regulate international trade contracts, in addition to supporting entities such as banks, transport companies, and insurance companies, and their role in facilitating contract implementation and ensuring the stability of international commercial transactions. The study concluded that the success of international trade contracts depends on the degree of integration and coordination among the various involved parties and supporting entities in achieving legal and economic security and stability. |
