تتناول هذه الدراسة موضوع حماية القصر من الجرائم المعلوماتية في التشريع الجزائري، في ظل التطور التكنولوجي المتسارع وما نتج عنه من تنامي الجرائم الإلكترونية الماسة بالأطفال. وتهدف إلى إبراز أهم صور الجرائم المعلوماتية التي تستهدف القاصر، وتحليل الآليات القانونية التي اعتمدها المشرع الجزائري لمواجهتها، خاصة من خلال قانون العقوبات وقانون حماية الطفل وقانون حماية المعطيات الشخصية. كما اعتمدت الدراسة على المنهجين الوصفي والتحليلي لتقييم مدى فعالية النصوص القانونية في توفير الحماية الجزائية للقاصر داخل البيئة الرقمية. وخلصت الدراسة إلى أن المشرع الجزائري سعى إلى تعزيز الحماية القانونية للقصر، إلا أن التطور المستمر للجريمة المعلوماتية يفرض ضرورة تحيين التشريعات وتدعيم آليات الوقاية والتوعية الرقمية.
Abstract This study addresses the protection of minors from cybercrime in Algerian legislation in light of rapid technological development and the increasing spread of electronic crimes targeting children. It aims to identify the most significant cybercrimes affecting minors and analyze the legal mechanisms adopted by the Algerian legislator to combat them, particularly through the Penal Code, the Child Protection Law, and the Personal Data Protection Law. The study relies on both descriptive and analytical approaches to assess the effectiveness of legal provisions in ensuring criminal protection for minors within the digital environment. The study concludes that the Algerian legislator has sought to strengthen legal protection for minors; however, the continuous evolution of cybercrime requires constant legislative updates and stronger preventive and digital awareness mechanisms. |
