الملخص:
تهدف هذه الدراسة إلى تحديد مفهوم الذكاء الاصطناعي ومستوياته لفهم طبيعته القانونية وشخصيته وتأثيرها على المسؤولية المدنية والمسؤولية الجنائية والمسؤولية الإدارية. تبدأ الدراسة بتعريف الذكاء الاصطناعي وخصائصه ومميزاته وإيجابياته وسلبياته، ثم الانتقال إلى المسؤوليات المترتبة عن استخدامات الذكاء الاصطناعي، ومن خلالها الوقوف على أهم ثلاث مسؤوليات يمكن أن تنشأ جراء الاستخدام لتقنيات الذكاء الاصطناعي ومحاولة إبراز المسؤولية المدنية والمسؤولية الجنائية الاصطناعي إلى جانب المسؤولية الإدارية. إن تدخل أنظمة الذكاء الاصطناعي في عدة مجالات انعكس بالإيجاب فيما وضعه من مسهلات للرقي بمختلف الجوانب غير أن انعكاسها على الجانب القانوني بعدم كفاية قواعده لاحتواء أضرارها نظرا لما تنطوي عليه من خصائص لا تشبه الضرر المعتاد، ما يزيد من تعقيد عملية تحديد المسؤول عن الضرر الناجم عن هذه التقنيات وخاصة أن القواعد القانونية في التشريع الجزائري لم تغطي ما يرتبه استخديسام هذه التقنيات من أضرار. Abstract "This study seeks to delineate the concept of Artificial Intelligence (AI) and its varying levels to ascertain its legal nature and personality, as well as its implications for civil, criminal, and administrative liability. The research commences with a conceptual definition of AI, exploring its characteristics, attributes, and inherent advantages and disadvantages. It subsequently transitions to an analysis of the legal liabilities arising from AI applications, focusing on the three primary pillars of liability: civil, criminal, and administrative. While the integration of AI systems across various domains has catalyzed significant advancements, it has simultaneously exposed the inadequacy of existing legal frameworks in addressing AI-related damages. The unique characteristics of such harm diverge from conventional legal injury, thereby complicating the attribution of liability. This challenge is particularly pronounced within the context of Algerian legislation, where current legal provisions remain insufficient to encompass the complex liabilities necessitated by the deployment of these technologies." |
