ملخص
تتناول هذه المذكرة موضوع الطبيعة القانونية لقرارات المحكمة الدستورية باعتباره من المواضيع المهمة في مجال القانون الدستوري، نظراً للدور الذي تؤديه المحكمة الدستورية في حماية الدستور وضمان احترام مبدأ سموه. وتهدف الدراسة إلى توضيح مفهوم القضاء الدستوري وبيان اختصاصات المحكمة الدستورية، مع التركيز على تحليل طبيعة القرارات الصادرة عنها ومدى اعتبارها قرارات قضائية أو ذات طبيعة سياسية ودستورية خاصة. اعتمدت الدراسة على المنهج الوصفي والتحليلي، وذلك من خلال عرض مختلف الاتجاهات الفقهية المتعلقة بتكييف قرارات المحكمة الدستورية، إضافة إلى دراسة حجية هذه القرارات وآثارها القانونية والزمنية، خاصة ما يتعلق بقرارات عدم الدستورية ومدى إلزاميتها بالنسبة للسلطات العامة. وقد خلصت الدراسة إلى أن قرارات المحكمة الدستورية تتميز بطبيعة قانونية خاصة تجمع بين الطابع القضائي والطابع الدستوري، مما يمنحها مكانة متميزة داخل النظام القانوني. Summary This dissertation examines the legal nature of Constitutional Court decisions as an important topic in constitutional law, due to the role of the Constitutional Court in protecting the Constitution and ensuring its supremacy. The study aims to clarify the concept of constitutional judiciary and the competencies of the Constitutional Court, while focusing on the analysis of the nature of its decisions and whether they are judicial decisions or possess a political and constitutional character. The research relied on descriptive and analytical methods through presenting the different doctrinal opinions concerning the legal characterization of Constitutional Court decisions, in addition to studying their authority and legal as well as temporal effects, particularly decisions declaring laws unconstitutional and their binding force upon public authorities. The study concluded that Constitutional Court decisions have a special legal nature combining both judicial and constitutional characteristics, which grants them a distinguished position within the legal system. |
