ملخص :
تناولت هذه الدراسة النظام القانوني للاتفاقيات الثنائية في مجال الاستثمار، من خلال توضيح الإطار المفاهيمي لهذه الاتفاقيات وخصائصها ومجال تطبيقها. كما أبرزت أهم الضمانات التي توفرها للمستثمر الأجنبي، مثل المعاملة الوطنية ومبدأ الدولة الأولى بالرعاية وحماية الاستثمارات من المخاطر غير التجارية. وتطرقت الدراسة كذلك إلى آليات تسوية المنازعات، خاصة المفاوضات والتوفيق والتحكيم الدولي باعتباره الوسيلة الأهم. وقد تبين أن هذه الاتفاقيات تسهم في خلق مناخ استثماري آمن وجاذب لرؤوس الأموال الأجنبية. وخلصت الدراسة إلى أن المشرع الجزائري اعتمد هذه الاتفاقيات كآلية لتحقيق التوازن بين حماية المستثمر الأجنبي وسيادة الدولة. Summary This study addressed the legal framework of bilateral investment agreements by clarifying their conceptual framework, characteristics, and scope of application. It also highlighted the main guarantees provided to foreign investors, such as national treatment, the most-favoured-nation principle, and protection against non-commercial risks. Furthermore, the study examined dispute settlement mechanisms, particularly negotiation, conciliation, and international arbitration as the most important method. It found that these agreements contribute to creating a secure and attractive investment climate for foreign capital. The study concluded that the Algerian legislator has adopted these agreements as a mechanism to balance the protection of foreign investors with state sovereignty. |
