الدعوى القضائية سلطة قانونية يخولها القانون للشخص للجوء إلى القضاء من أجل حماية حق أو مركز قانوني، وقد كفل الدستور الجزائري هذا الحق، غير أن المشرع قيّده بشرطي الصفة والمصلحة وفقا للمادة 13 من قانون الإجراءات المدنية والإدارية. وتتميز الإجراءات القضائية في الجزائر بطابعها التحقيقي ومبدأ المواجهة بين الخصوم وتبادل الدفوع، كما تخضع لقواعد وإجراءات قانونية دقيقة تنظم رفع الدعوى وسيرها إلى غاية صدور الحكم. ويُستخلص أن الالتزام بقواعد وإجراءات قانون الإجراءات المدنية والإدارية يعد شرطا أساسيا لقبول الدعوى، وإلا كانت معرضة للرفض شكلا أو موضوعا. Abstract: A lawsuit constitutes a legal prerogative conferred by law upon individuals enabling them to resort to the judiciary for the protection of a right or a legally recognized interest. The Algerian Constitution guarantees this right; however, the legislator has restricted its exercise to the requirements of legal standing and interest, pursuant to Article 13 of the Code of Civil and Administrative Procedure. Judicial proceedings in Algeria are characterized by an inquisitorial nature, the principle of adversarial proceedings, and the exchange of pleadings between litigating parties. They are further governed by strict procedural rules regulating the initiation of proceedings and their conduct until the issuance of a judicial decision. It follows that compliance with the provisions of the Code of Civil and Administrative Procedure constitutes a fundamental prerequisite for the admissibility of the lawsuit; otherwise, it may be dismissed either on procedural or substantive grounds. |
