الملخص :
اتخذت المعلومات و الوثائق الإدارية مكانة هامة من طرف المشرع الجزائري، و ذلك تواكبا مع المخاطر التي تمس بها من تسريب و إفشاء و إتلاف لها عمدا أو عن غير عمد من طرف الموظف العمومي أو الغير ، و هذا ما دعى لتصدي هذه الإضرار من خلال إصدار قانون مستقل بتاريخ 09 يونيو 2021 تحت رقم 21-09 المؤرخ في 27 شوال عام 1442 ه الموافق ل 08 يونيو 2021 المتعلق بالحماية القانونية للمعلومات و الوثائق الإدارية المتعلق بالدولة و مؤسساتها المختلفة و الذي تضمن آليات قانونية و إجرائية في حالة الإخلال به، و أقر عقوبات مشددة لها خلافا عن باقي القوانين. Information and administrative documents have acquired important status under Algerian legislation, in line with the risks affecting them , such as leakage , disclosure, and destruction, whether intentional or unintentional, by public officials or third parties. This situation prompted the legislature to address this harms by enacting an independent law on June9, 2021, relating to the legal protection of information and administrative documents concerning the state and its various institutions. This law includes legal and procedural mechanisms in the event of violations thereof, and establishes stricter penalties compared to other laws. |
