تتناوح هذه الدراسة إشكالية قانونية راهنة تتعلق بالمسؤولية المدنية النالمة عن استخدام ع ولمود األطرالتقني المتسار أنظمة الذكاء االصطناعي، انط قا من الفجوة المتسعة بين الواق البحث ان القواعد المدنية التشريعية التقليدية، وال سيما في السياق الجزائري، وقد كش الك سيكية تعجز في أحيان كثيرة عن تحديد المسؤوح بدقة حين تحدث هذه األنظمة اضرارا، نظرا الستق ليتها التشغيلية وتعدد األطراف المتدخلة في دورة حياتها، ومن ثم، فإن الحالة باتت لزائري متخصص يرسي قواعد واضحة لتوزي المسؤولية وضمان التعويض العادح، ملحة الى تشري المقارنة الدولية ومستجيبا لمتطلبات مرحل مستفيدا من التجارة تاريخية باتت فيه ا لة شريكا القرار واحداث األثر القانوني. في صن فاع General Summary: This study addresses a contemporary legal from the use of artifical intelligence systems,stemming from the widening gap between the rapidly evolving technological reality and the rigidty of traditional legislative frameworks, particularly in the algerain context the research reveals that classical civil law ruels are often incapable of precisely identifying the liable party when these systems cause harm, given their operational autonomy and the multiplicity of parties involved throughot their lifecycle. Consequently, the need has become urgent for a specialized algerian legislation that establishes clear ruels for distributing liability and ensuring fair comparative experiences and responding to the demands of a historical phase in which the machine has become an active participant in decision_making and in producing legal effects. |
